Department of Land Information: Subdivision Ordinance
POLK COUNTY SUBDIVISION ORDINANCE

The Subdivision Ordinance has the following main provisions:
 
A survey is required for creating a new lot of less than 19 acres.
Creation of 1-4 parcels of 19 acres or less within a five-year period is a minor subdivision, needing review and approval from the Land Information Office.
Creation of 5 or more parcels of 19 acres or less within a 5-year period is a major subdivision, needing review and approval by the Planning and Zoning Committee.
Minimum lot size is 1 acre (43,560 sq ft), unless larger lots are required by other County ordinances (Shoreland, Zoning, etc.) or Town requirements. The Ordinance allows for a series of different lot sizes that will be in effect if Towns choose to adopt new lot sizes. If a Town does not adopt new lot sizes, then the minimum remains one acre (unless Town or Shoreland or other ordinances apply)
Up to two lots may be served by one driveway; otherwise more than two lots must be served by a road built to minimum Town Road specifications, whether public or private.

Prior to submitting a plat for County review, a Town Checklist must be prepared and signed by the Town Board of the Town in which the plat is located. This checklist indicates to the County the Town's requirements on certain design standards. Click here for a copy of the Town Checklist.
