On Monday, February 12, 2007 at 8:21 a.m. the Polk County
Sheriff’s Department received a call from a resident in the rural Luck area. The
complaint was in reference to a violation of a restraining order between Jeffrey
Scott Wagner (age 47 of Edgerton, WI.) initiated by his former wife. A
Deputy from the Sheriff’s Department found that the violation involved Mr.
Wagner picking up his 7-year-old son, Zachary, without the biological mothers
knowledge or consent. The mother had legal physical placement, with the
father having joint custody.
Jeffrey Wagner left a voice message to the mother
indicating that he had not seen his son in about one month and he was exercising
his visitation rights. Jeffrey Wagner further indicated that he would return the
child to school the following day.
On Tuesday, February 13, 2007 the mother and a Deputy
waited at Zachary’s school for Jeffery Wagner to return the child. Jeffery
Wagner did not arrive. Based on this information, the Polk County
Sheriff’s Department petitioned the court for a felony warrant for Jeffrey
Wagner’s arrest, for “Interference with custody by parent”. The warrant
was granted and was entered, in the National Crime Information Center, along
with an attempt to locate Zachary Wolfe. Authorities in western states
were also notified in anticipation that Wagner would visit relatives living
On Wednesday, February 14, 2007 the Polk County Sheriff’s
Department received information from the Beloit (WI) Police Department that
Jeffrey Wagner had not arrived at work on Tuesday evening and it appeared he had
not been to his residence.
The Polk County Sheriff’s Department obtained subpoenas
for bank records, cellular telephone records, and requested the F.B.I. to assist
in flight records for area airports.
An investigator for the Sheriff’s Department was calling
numbers that were provided by the cellular phone carrier and located one that
was listed to the AmericInn, in Richfield MN. A call to this business
resulted in a possible location for Jeffrey Wagner. The Richfield Police
Department responded immediately to the motel and forced entry into the room.
At that time the Richfield Police Department advised that
they found one adult male and one juvenile male in the room, deceased.
They were identified as the bodies of Zachary Wolfe and Jeffrey Wagner.
This investigation continues, with the Richfield (MN)
Police Department, Beloit, (WI) Police Department and the Polk County Sheriff’s
Department working together involving the abduction and apparent homicide of
Zachary Wolfe and subsequent death of Jeffrey Wagner.
